WHAT IS IN A SURNAME? AN ENQUIRY INTO THE UNAUTHORISED NAME CHANGES OF MARRIED WOMEN

In recent years there have been reports of the Department HomeAffairs changing women’s surnames to that their husbands upon theconclusion a marriage without married consent. Thisconduct by Home Affairs officials infringes, as thisarticle will argue, not only on affected right justadministrative action but also rights equality and dignity and,in some instances, freedom movement universal suffrage. Thisarticle enquires into possibility taking conduct theDepartment Affairs, which arguably amounts administrativeaction, judicial review seeking systemic relief. It look at thesexist patriarchal social norms relied justify ofthe calls for intervening measures thatnot result in broader recognition effectivelydismantle systems frameworks inequality continue tomarginalise subjugate women socially constructed genderhierarchy.
